Terms of Service
§1. General Provisions
1. These Terms of Service define the rules for providing services electronically by Nowoczesne Terapie (hereinafter: "Service Provider").
2. The Service Provider offers personal development sessions, energy harmonization, and spiritual coaching services (hereinafter: "Sessions").
3. These Terms are made available free of charge on the website in a form that allows downloading, saving, and printing.
4. Using the website constitutes acceptance of these Terms.
§2. Definitions
1. Service Provider - Nowoczesne Terapie, the owner and operator of the website.
2. Client - a natural person who is at least 18 years old and uses the Service Provider's services.
3. Session - an individual online advisory meeting in the field of personal development and energy harmonization, lasting 60 minutes.
4. Package - a set of 3 Sessions at a promotional price.
5. Booking - selection of a Session date through the website form.
6. Distance Contract - a contract concluded with the Client through the website, without the simultaneous physical presence of both parties.
§3. Type and Scope of Services
1. The Service Provider offers the following services:
a) Single Session (60 minutes) - price: 222 PLN
b) Package of 3 Sessions - price: 222 PLN
2. Sessions are conducted online (video or phone call) at the agreed time.
3. Sessions are strictly advisory in the field of personal development and do not constitute medical, psychotherapeutic, psychological, or legal services.
4. The Service Provider does not guarantee specific results - outcomes depend on the Client's individual engagement.
§4. Booking and Contract Conclusion
1. Session booking is made through the form on the website.
2. To make a Booking, the Client provides: first name, phone number, email address, and selects a Session date.
3. Making a Booking constitutes an offer to conclude a Distance Contract.
4. The contract is concluded when the Service Provider confirms the Booking (confirmation sent via email).
5. Before making a Booking, the Client is required to read these Terms and the Privacy Policy.
§5. Prices and Payments
1. All prices listed on the website are gross prices expressed in Polish zloty (PLN).
2. The Session price is binding at the time of Booking.
3. Available payment methods: bank transfer, BLIK. Detailed payment information is provided upon Booking confirmation.
4. Payment should be made within 24 hours of Booking confirmation.
5. If payment is not received within the above timeframe, the Booking may be cancelled.
§6. Right of Withdrawal
1. In accordance with EU consumer protection law, the Client who is a consumer has the right to withdraw from a distance contract within 14 days of contract conclusion, without giving any reason.
2. To exercise the right of withdrawal, the Client should inform the Service Provider of their decision via email with a clear statement.
3. In the event of withdrawal, the Service Provider shall refund all payments received no later than 14 days from the day of receiving the withdrawal statement.
4. Loss of withdrawal right: If the Session has been fully performed with the Client's explicit consent before the expiry of the withdrawal period, the Client loses the right to withdraw.
§7. Rescheduling and Cancellation
1. The Client may reschedule a Session free of charge by informing the Service Provider at least 48 hours before the scheduled time.
2. Cancellation at least 48 hours before the Session: the Client is entitled to a refund of 80% of the Session value.
3. Cancellation less than 48 hours before: does not entitle the Client to a refund.
4. Failure to attend a Session without prior notice is treated as a completed Session - no refund is due.
5. The Service Provider reserves the right to cancel or reschedule a Session due to unforeseen circumstances, offering the Client a new date or a full refund.
§8. Client Obligations
1. The Client uses the services voluntarily and at their own responsibility.
2. The Client agrees to provide truthful data in the booking form.
3. The Client ensures appropriate technical conditions for an online Session (stable internet connection, device with camera and microphone).
4. The Client agrees to maintain confidentiality regarding the content of Sessions.
§9. Liability and Exclusions
1. Sessions are advisory in nature and do not constitute medical, psychological, or legal advice.
2. The Service Provider is not liable for decisions made by the Client based on Session content.
3. For health, mental, or legal issues, the Client should consult an appropriate specialist.
4. The Service Provider is not liable for technical problems on the Client's side that prevent conducting a Session.
5. The Service Provider's maximum liability is limited to the value of the paid Session.
§10. Complaints
1. The Client has the right to file a complaint regarding the services provided.
2. Complaints should be submitted via email to the address provided on the homepage.
3. A complaint should include: the Client's name, Session date, description of the issue, and expected resolution.
4. The Service Provider will process the complaint within 30 days of receipt and inform the Client of the decision via email.
5. Failure to respond within 30 days is deemed acceptance of the complaint.
§11. Out-of-Court Dispute Resolution
1. The Client who is a consumer may use out-of-court complaint and claim resolution methods.
2. The Client may also use the ODR (Online Dispute Resolution) platform available at: ec.europa.eu/consumers/odr.
§12. Intellectual Property
1. All materials provided to the Client during Sessions (including exercises, techniques, recommendations) are the intellectual property of the Service Provider.
2. The Client may not copy, distribute, or use them for commercial purposes without the Service Provider's written consent.
3. Recording Sessions by the Client is prohibited without the Service Provider's prior written consent.
§13. Confidentiality
1. The Service Provider undertakes to keep confidential all information obtained from the Client during Sessions.
2. Exceptions are situations where disclosure is required by applicable law.
§14. Personal Data
The rules for processing Clients' personal data are defined in the Privacy Policy, which forms an integral part of these Terms.
§15. Technical Requirements
1. Using the website requires: a device with Internet access, a current web browser, and an active email address.
2. Participation in an online Session additionally requires: a stable internet connection, camera, and microphone.
§16. Amendments
1. The Service Provider reserves the right to amend these Terms for important legal or organizational reasons.
2. Amended Terms will be published on the website.
3. Bookings made before the amendment will be performed under the previous Terms.
§17. Final Provisions
1. Matters not regulated by these Terms shall be governed by applicable law, in particular the Polish Civil Code and the Consumer Rights Act.
2. These Terms come into effect upon publication on the website.
